Introduction
SAL Nursing Service Ltd.. (hereinafter: "the Company") wishes to offer tourists staying in hotels in Israel the opportunity to purchase remote body examination services using the Tyto Care device (hereinafter: "the device") .
To supply the device, a service agreement has been made with Tyto Care LTD (hereinafter: "Tyto") which developed the device and owns the rights to it.
Using the device, patient can independently perform a range of tests without going to a medical facility. The device transmits body measurement data through the "Tyto" application, enabling remote medical consultation services (hereinafter: "remote service" or "the service"). The remote service is also available for children.
The detailed terms below are the mandatory terms of use of the device and receiving remote service through it.
If the purchaser is a parent of a minor, they must approve the terms below for the minor to receive remote service.
Since the Company subsidizes the device's price, there will be only one device in each hotel, unless otherwise decided.
It is the patient's responsibility to report any defect or damage to the device to the service center immediately.
Device Delivery
The patient is responsible to Pick upthe Tyto device from the hotel reception desk to their room for examination, approximately 15 minutes before the start of the remote diagnostic service. After the consultation, The patient is must return the Tyto device to the reception.
Transaction Cancellation:
Transaction cancellation is subject to the Consumer Protection Law, 1981.
Without prejudice to the law, the transaction can be canceled from the payment date until 60 minutes after receiving the device.
Device Warranty:
Tyto Care LTD provides a warranty for the Tyto device.
The warranty is provided by Tyto Care LTD, and therefore the patient is subject to Tyto's terms as stated in the application. Accordingly, the warranty will not apply if the device is used not in accordance with Tyto's terms and/or the terms specified below.
Remote Service:
Diagnosis by the medical authority at SALis provided according to the patient's measurement data. In any case where the patient feels deterioration in their medical condition, they must seek immediate medical assistance.
The medical authority on behalf of SALwill document the diagnosis given through the remote service.
SALwill not be responsible in any case of incorrect or incomplete diagnosis due to inaccurate measurements.
SALwill not be liable for any patient's use of the device that is not in accordance with Tyto's terms and/or the terms specified below.
Patient Declaration:
The use of the device is subject to my statements and commitments as follows:
I understand that the specified service terms constitute a contract between me and the Company, and using the Tyto device constitutes an agreement to them. Therefore, I hereby confirm that I will read the terms before using the device and/or the "TYTO" application, according to the terms detailed below.
I understand that the remote diagnosis is provided by the Tyto device based on the measurement data I provide under the guidance of SL medical team, and my signature constitutes agreement and commitment on my part to act in accordance with Tyto's terms and the terms detailed below.
I agree to provide information to the Company for the purpose of providing the service and consent to the Company collecting my information.
If I wish to cancel the remote diagnosis transaction, I undertake to inform the Service SALhotline up to 60 Minutes before the scheduled service, and if I have taken the device, I must return it to the reception.
I am aware that both through the measurements performed by me and through the data entered or collected with the device or application's permissions, data is transmitted from the device to my mobile phone and from there to the Company's systems through the internet/server network, which are not under SAL's control or responsibility. Therefore, I know and agree that I am solely and exclusively responsible for maintaining the privacy of my information and its security, including the security of the means through which the information is transferred to the Company, and I also know and agree that SALis not responsible for any matter related to the security of the authority used to transfer the information or for any damage that may be caused as a result of transferring the information as mentioned in relation to these servers and the information stored in them.
Accordingly, I hereby waive any claim or demand against SALregarding the measurement data that will be generated in the devices and/or transmitted between them and/or stored in servers that are not SAL's servers (including with regard to compromising my privacy and/or medical confidentiality as a result of using the remote service). I am aware that this data, including measurement data, is collected, transmitted, and processed in accordance with the privacy policy of the Company, which is not under the control or responsibility of SAL.
I hereby declare that I will take reasonable precautions to protect the confidentiality of my information that will be provided to me during the purchase and operation of the remote service.
I am aware that SALwill not be responsible and will not bear any liability for any damage and/or expense that may be incurred to you and/or a third party as a result of the violation of these terms.
After reading this, I understand the purpose of the service, how to use the device, the risks associated with its use, and I know that SAL will not be liable for any damages that may occur.
